In this Privacy Policy of Insights Planning LLC (“the Company” or “We”), you (“the Client” or “You”) will find information about how we use your personal data (“personal information”) when you use or visit and of our websites, including insightsplanning.com, posicoach.com, or use the third-party apps provided by The Company.  

In summary:

  • We only use personal information:
    • for our clients to be able to use the Company website and/or app
    • for our legitimate business purposes (e.g., making general analyses for our own business insights, advertising, communicating with you, maintaining a relationship with you, administering our business with you, to monitor the effectiveness of our services, to improve our services)
    • to comply with legal obligations
  • We do not sell your personal information
  • We do not share your personal information with 3rd parties
  • We use Google tags on our website to track the effectiveness of our website and advertising.
  • We do not use automated decision-making tools with legal effects or that may otherwise significantly impact you
  • We store your personal information in the United States or in nations that have strict privacy laws that protect your data.
  • We have implemented appropriate technical and organizational measures to secure your personal information
  • We use a small number of third-party provider apps to deliver services to you:
    • Calendly.com and Tally.com to schedule introductory calls and receive your contact information.
    • Quenza (quenza.com) is used to provide workflow, document management, notes, and communication features
    • CarePatron (carepatron.com) is used for administration and payment links to Stripe
    • Stripe (stripe.com) is used to provide payment services
    • We reserve the right to add, change, or delete third-party provider apps to improve our service and business

Personal Information

Client's personal information

When referring to “you” in this section, we mean the Client. You cannot derive any rights from this text.

What personal information do we process?

We process the following personal client information:

  • title
  • first name
  • last name
  • email address
  • phone number (optional)
  • profession (optional)
  • profile picture (optional)
  • street name & number (optional)
  • postal code (optional)
  • city (optional)
  • state
  • country
  • time zone
  • Stripe payment identifier (not your credit card details)
  • information you enter into the Quenza app, such as notes, answers, and ratings

The Company may collect statistical data on activity, intervention, standardized measures, program utilization, effects, and effectiveness, not to include personally identifiable information.

Why does the Company process your personal information?

The Company will process your personal information for the following purposes:

  • To be able to administer the workflow, including making notes, viewing and managing information about you in relation to your personal growth
  • To keep in contact with you through the app
  • If you have a client account in the app: to be able to view relevant information such as notes about you and activity results
  • If compelled by law, to fulfill legal obligations
  • To complete monetary transactions
  • To make meeting appointments
  • To improve the effectiveness of the offered activities, interventions, programs, and processes
On what legal basis does the Company process your personal information?

The Company will process your personal information to perform its agreement with you, to fulfill legal obligations, and for the Company’s legitimate interest in managing its business.

With whom does the Company share your personal information?

The Company shares your personal information with Quenza in order for Quenza to offer the app to you if you have engaged the Company for services using the Quenza app. Beyond that, the Company does not share your personal information without your knowledge and further consent unless required by a court order or by law to protect life and safety. Appointments and administration are managed through CarePatron.The Company does not directly control any personal information you enter through CarePatron. Payments are managed through Stripe. The Company does not directly control any personal information you enter through Stripe. These are the primary business relationships we use to deliver services to you and manage our business. Incidental 3rd party relationships that may involve sharing your contact information are mentioned and updated in the summary at the top of this policy.

How long is your personal information stored?

You or the Company determine how long your personal information is stored. Making use of the privacy settings within the Quenza app you can remove your account and all related personal information stored by Quenza. The Company will store your personal information during its work with you. If you are no longer an active client of the Company, the Company may delete all personal data stored by Quenza after 60 days unless other arrangements are made. The Company may also optionally delete your files that contain personally identifiable information after 60 days from your last session. The Company may store information that does not include personally identifiable information as long as it is useful to the Company.

Why does the Company process your personal information?

We process your personal information for the following purposes: 

  • To send requested email directly or via third-party provider Amazon Simple Email Services.
  • To analyze statistics of visitors to our website and email (functional cookie IDs)
  • To analyze preferences of website visitors, based on previous or current website activity, so that we can improve our services (functional cookie IDs)
  • Aggregating data about site traffic and site interaction so that we can offer better site experiences and tools in the future (functional cookie IDs). 

Tracking

We use Google tags and services to improve our website and ads. Therefore, your use of our website is shared with Google. if you do not want this information shared with Google, please see Google's current options for opting out of their tracking. The Company does not have control over your service providers or the networks processing internet traffic. Tracking technology and techniques are constantly evolving, and we cannot guarantee your complete anonymity when visiting the Company websites, Stripe, or Quenza. You must take appropriate actions as you deem necessary and prudent to further protect against 3rd parties and service providers who may track your internet and web activity.

Do we sell your personal information?

No. We do not sell or trade your personal information. We also do not offer financial incentive for the submission of your personal information. 

Third-party disclosure

We make use of service providers, such as the hosting provider of our website (FastComet Inc.), the hosting provider for the app (Quenza B.V.), a payment service provider (Stripe), an administrative service provider (CarePatron), and an email service provider (Amazon Simple Email Services), to be able to offer and operate our websites, apps and our business.  We may be required by law to disclose certain personal information. If so, we will then endeavor to only disclose personal information that is strictly required pursuant to applicable laws. 

Where do we store your personal information?

Data stored in the Quenza app is hosted in the Netherlands, Germany, Belgium, Ireland, Denmark and/or Finland with Privacy Shield and/or SCC certified providers. All other Personal data is stored in the United States.

How do we protect your personal information?

Our insightsplanning.com, posicoach.com, thrivingknights.com, and thryvinglife.com websites are scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible. We use up-to-date software to conduct regular Malware Scanning on our computer systems. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems and are required to keep the information confidential. In addition, all sensitive information you supply is encrypted via Secure Socket Layer (SSL) technology when in transit and is encrypted at rest within the database. All our systems use available security protocols, including passwords, two-factor authentication, and encryption. All financial transactions are processed through a trusted payment provider (Stripe) and are not stored or processed on our servers. It is our policy not to send personal information of any kind via unsecured email services.

Your rights

What rights do you have regarding your personal information?

Pursuant to the GDPR and California privacy law, you have the following rights regarding your personal information:

  • the right to request access to your personal information.
  • the right to receive information about the processing of your personal information.
  • the right to have incorrect personal information rectified (please note that if you have a Quenza account, you can always change your personal information in your account).
  • under certain conditions to have your personal information erased (with a Quenza account, you can initiate the removal of partial data or your entire account).
  • under certain conditions to have the processing of your personal information restricted.
  • under certain conditions to object to the processing of your personal information.
  • when we use your personal information for direct marketing purposes, you can object to this unconditionally. 
  • if you have given consent for the processing of your personal information, to revoke that consent (this applies to future use of your personal information).
  • the right to receive your personal information in a structured, commonly used, machine-readable format, where it concerns personal information (i) you have submitted to us and (ii) we process based on your consent or required for the performance of our contract with you and (iii) that is processed by automated means; in that case, you may also ask us to transfer your personal data to another processor, where technically feasible (the Quenza app contains an export function which allows you to export your entered and results);
  • you have the right to lodge a complaint with the Company and your local supervisory authority. You may also have other rights under other applicable data protection/privacy legislation, such as the right to non-discrimination (we will not discriminate against you when you exercise your rights under applicable laws). If we are the controller for your personal information (information stored outside of the Quenza app, Strip, or Calendly), you may send a request regarding your personal information using the contact details under ‘Contacting Us’ below.  Please note that we may be entitled under applicable laws to refuse a certain request.
